Send Letter to CEPA Review Committees
The House of Commons and the Senate have begun committee hearings for the review of the Canadian Environmental Protection Act (CEPA 1999).
The Canadian Environmental Protection Act (CEPA) is Canada’s principal piece of federal environmental protection legislation. It addresses issues that range from controlling toxic substances to public participation, biotechnology, nutrients, hazardous waste, fuel standards and vehicle emissions, international air and water pollution, disposal at sea, and other measures. The CEPA needs fixing.
The first hearings for the House of Commons and Senate committees have been to determine the scope of their review. While some key environment issues are being addressed, many issues remain to be brought to the committees’ attention.
In order for this review to show the politicians that Canadians care about CEPA and its effectiveness (or not) in dealing with pollution, toxic chemicals and ecosystems, the environmentalists who have been following the review process believe that community based activists need to write a simple letter or a longer brief to the two committees. Our voices need to be heard! The committees need to hear about the impact of pollution in your community, of your attempts to protect the environment, to get CEPA enforced, to use CEPA to control toxic pollution, to hear the stories of CEPA (for better or worse) and of real people fighting real battles against pollution. Indeed, the House of Commons committee has asked: “ To reinforce recommendations, or to help the Committee formulate its own, it would be very useful to have specific examples of the success or failure of the management of a given substance or substances.”

Review of Act by Parliamentary Committee:
2005-2006 (CURRENT PHASE)
According to Section 343 of CEPA, a Parliamentary Committee
must review the Act every five years after the Act comes
into force. The Committee conducts a comprehensive
review of the effectiveness of the CEPA in preventing pollution
and protecting the environment and human health and then
prepares a report to Parliament with its recommendations.
On April 5, 2005, a motion was passed in the House of Commons
making the Standing Committee on Environment and Sustainable
Development responsible for the review of CEPA 1999.
The identification of CEPA issues and themes is expected
to begin in the fall of 2005, with the one-year review to
follow.
A strong participation and representation from
the public (individuals and representatives of public interest
groups) before the Parliamentary Committee is all the more
crucial during this phase of the review period, particularly
since CEPA 1999 is under attack from many quarters.
ENGOs involved in pre-review discussions on CEPA strongly
encourage you to request to appear before the Parliamentary
Committee to voice your concerns and views on CEPA.
